释义	出版者享有专有著作权。图书出版者对著作权人交付出版的作品，按照合同约定享有的专有出版权受法律保护，他人不得出版该作品。出版社（即图书出版者）出版图书时，应与作者（著作权人）订立出版合同。这既是《著作权法》的要求，也是避免纠纷的需要。出版合同要对合同双方的权利义务作出明确的约定。法律依据《中华人民共和国著作权法》第三十条图书出版者出版图书应当和著作权人订立出版合同，并支付报酬。
