释义	法律分析：一般案件的话,原告是可以委托代理人然后仅代理人出庭,原告本人可不出庭。但一些特殊案件,如离婚纠纷,即便委托了代理人,原则上原被告本人还是需要出庭的法律依据：《最高人民法院关于审理民间借贷案件适用法律若干问题的规定》第十八条关于适用〈中华人民共和国民事诉讼法〉的解释》第一百七十四条第二款负有举证证明责任的原告无正当理由拒不到庭，经审查现有证据无法确认借贷行为、借贷金额、支付方式等案件主要事实，人民法院对其主张的事实不予认定
