释义	医疗事故与医疗意外是有区别的。所谓医疗事故，是指医疗机构及其医务人员在保疗活动中，违反医疗卫生管理法律、行政法规、部门规章和诊疗护理规范、常规，过失造成患者人身损害的事故。也就是说，在医疗事故中，医疗机构及其工作人员存在过失行为。而医疗意外则是指由于患者的特殊体质或者异常病情而发生的难以预料和防范的不良后果，对于此后果，医院方不能预见，主观上也不存在过错。法律依据: 《医疗事故处理条例》第三十三条在医疗活动中，由于患者病情异常或者患者体质特殊而发生医疗意外的，不属于医疗事故。
