释义	法律分析：劳动者辞职，提前一个月提出申请，可以解除劳动合同。在试用期内，提前3天通知用人单位，可以解除劳动合同。如是用人单位违法，如“为及时足额支付劳动者报酬的”或“未依法为劳动者缴纳社会保险费的”等违反法律规定的做法，劳动者可随时解除劳动合同，不仅用人单位应及时结算工资，而且还需依法支付劳动者的经济补偿金。法律依据：《中华人民共和国劳动合同法》第三十七条劳动者提前三十日以书面形式通知用人单位，可以解除劳动合同。劳动者在试用期内提前三日通知用人单位，可以解除劳动合同。
