伪证是非法取得的证据吗
释义
法律分析：伪证不算非法取得证据。伪证是由案件的当事人主动提供的而不是办案人员设法取得的，所以自然不算非法取得证据。
伪证是在诉讼过程中，证人、鉴定人、记录人、翻译人对与案件有重要关系的事实情节，故意作虚假证明、鉴定、记录、翻译，意图陷害他人或者隐匿罪证的行为。
法律依据：《刑法》第305条，在刑事诉讼中，证人、鉴定人、记录人、翻译人对与案件有重要关系的情节；
故意作虚假证明、鉴定、记录、翻译，意图陷害他人或者隐匿罪证的，处三年以下有期徒刑或者拘役；情节严重的，处三年以上七年以下有期徒刑。
