释义	劳务关系不属于劳动关系，不能适用劳动合同法规定的最低工资标准。最低工资，是指劳动者在法定工作时间提供了正常劳动的前提下，其所在用人单位必须按法定最低标准支付的劳动报酬。建立劳务关系后，用工小时计酬标准不得低于用人单位所在地人民政府规定的最低小时工资标准。具体工资数额由双方协商确定。法律依据：《最低工资规定》第三条本规定所称最低工资标准，是指劳动者在法定工作时间或依法签订的劳动合同约定的工作时间内提供了正常劳动的前提下，用人单位依法应支付的最低劳动报酬。
