释义	1、转租经房屋所有权人的同意。转租已不属于正常使用的范畴，必须经房屋所有权人同意，否则无效。2、转租的租金不高于原租金。租金是房屋的收益，应由房屋所有权人取得。凡未经房屋所有权人同意而转租的，或谋取租金差价的转租，房屋所有权人有权要求追究承租人的违约责任，并可解除房屋租赁合同，收回出租房屋。法律依据《商品房屋租赁管理办法》第十一条承租人转租房屋的，应当经出租人书面同意。承租人未经出租人书面同意转租的，出租人可以解除租赁合同，收回房屋并要求承租人赔偿损失。
