释义	醉驾发生交通事故不会加重处罚。只要是醉酒驾驶机动车的，驾驶员均构成危险驾驶罪；如果因醉酒驾驶机动车而发生交通事故，构成交通肇事罪的，则应按交通肇事罪进行处罚，对于醉酒驾驶机动车的行为，应作为量刑情节考虑，予以适当从重处罚。【法律依据】《刑法》第一百三十三条违反交通运输管理法规，因而发生重大事故，致人重伤、死亡或者使公私财产遭受重大损失的，处三年以下有期徒刑或者拘役；交通运输肇事后逃逸或者有其他特别恶劣情节的，处三年以上七年以下有期徒刑；因逃逸致人死亡的，处七年以上有期徒刑。
