释义	律师解答：实践合同又称要物合同，是指除当事人双方意思表示一致外，还须交付标的物或完成其他现实交付才能生效的合同。诺成合同指仅以当事人意思表示一致为成立要件的合同。诺成合同自当事人双方意思表示一致时即可成立，不以一方交付标的物为合同的成立要件，当事人交付标的物属于履行合同，而与合同的成立无关。【法律依据】：《中华人民共和国民法典》第一百一十九条依法成立的合同，对当事人具有法律约束力。第一百二十条民事权益受到侵害的，被侵权人有权请求侵权人承担侵权责任。
