释义	法律主观：员工在产假期间公司应当发放工资。产假，是指在职妇女产期前后的休假待遇，一般从分娩前半个月至产后两个半月，晚婚晚育者可前后长至四个月，女职工生育享受不少于九十天的产假。职业女性在休产假期间，用人单位不得降低其工资、辞退或者以其他形式解除劳动合同。现在我国正式实施的产假标准依据2012年4月18日国务院常务会议审议并原则通过的《女职工劳动保护特别规定（草案）》。草案将女职工生育享受的产假由90天延长至98天，并规范了相关待遇。
