释义	法律分析：依据我国相关法律的规定，未经对方当事人同意私自录音的材料，是不能作为证据使用的，以违法证据排除规则排除使用。《最高人民法院关于未经对方当事人同意私自录音取得的资料能否作为证据使用问题的批复》河北省高级人民法院：你院冀高法〔1994〕39号请示收悉。经研究，答复如下：证据的取得首先要合法，只有经过合法途径取得的证据才能作为定案的根据。未经对方当事人同意私自录制其谈话，系不合法行为，以这种手段取得的录音资料，不能作为证据使用。
