释义	法律分析：建筑工程的劳务作业，一直都是要求有相关资质的企业承包的，没有资质的企业是不能参与劳务作业的。法律依据：《中华人民共和国建筑法》第六十六条建筑施工企业转让、出借资质证书或者以其他方式允许他人以本企业的名义承揽工程的，责令改正，没收违法所得，并处罚款，可以责令停业整顿，降低资质等级节严重的，吊销资质证书。对因该项承揽工程不符合规定的质量标准造成的损失，建筑施工企业与使用本企业名义的单位或者个人承担连带赔偿责任。
