释义	《民法典》规定，农村土地承包人取得农村土地承包经营权，而土地承包经营权自土地承包经营权合同生效时设立。土地承包经营权，是指承包农户以从事农业生产为目的，对集体所有或国家所有的由农民集体使用的土地进行占有、使用和收益的权利。在土地利用过程中，土地承包经营权人应当维持土地的农业用途，不得用于非农建设，禁止占用耕地建窑、建坟或者擅自在耕地上建房、挖砂、采石、采矿、取土等，禁止占用基本农田发展林果业和挖塘养鱼。
