释义	根据《房屋建筑和市政基础设施项目工程总承包管理办法》第十六条：企业投资项目的工程总承包宜采用总价合同，政府投资项目的工程总承包应当合理确定合同价格形式。采用总价合同的，除合同约定可以调整的情形外，合同总价一般不予调整。建设单位和工程总承包单位可以在合同中约定工程总承包计量规则和计价方法。依法必须进行招标的项目，合同价格应当在充分竞争的基础上合理确定。
