释义	根据我国现有法律法规规定，单位的法定代表人可以依法进行工商变更登记，但却不能直接去掉法定代表人在单位没有确定新的法定代表人情况下，市场监督管理部门不可能同意单位将原法定代表人去掉。想辞去法定代表人的人员，可以通过内部协商解决，协商不成的话，直接到法院起诉即可。《公司法》第13条，公司法定代表人依照公司章程的规定，由董事长、执行董事或者经理担任，并依法登记。公司法定代表人变更，应当办理变更登记。
