释义	法律分析：驾驶人体内每百毫升血液酒精含量大于20毫克就算酒后驾驶，大于等于80毫克即为醉酒驾驶。醉酒驾驶是指因饮酒而完全丧失或部分丧失个人意志，醉酒后，不能在道路上驾驶机动车追逐竞驶，构成醉驾行为的，是会被处拘役，并处罚金，拘役的期限，为一个月以上六个月以下。如果构成其他犯罪的，依照处罚较重的规定定罪处罚。法律依据：《中华人民共和国刑法修正案(八)》第一百三十三条之一：在道路上驾驶机动车追逐竞驶，情节恶劣的，或者在道路上醉酒驾驶机动车的，处拘役，并处罚金。
