释义	法律分析：目前在我国只有检察院和法院享有批捕权，但是没有逮捕权，逮捕权是公安机关所有的。逮捕是国家司法机关所采取的、在一定时间内完全剥夺犯罪嫌疑人或被告人人身自由的强制措施。逮捕应具备的3个条件：有证据证明有犯罪事实；犯罪嫌疑人所涉嫌的罪可能被判处徒刑以上刑罚；采取取保候审、监视居住等方法，尚不足以防止发生社会危险性，而有逮捕必要。法律依据《刑事诉讼法》第八十条逮捕犯罪嫌疑人、被告人，必须经过人民检察院批准或者人民法院决定，由公安机关执行。
