法律分析：构成生产并销售劣药罪的要件：
1、犯罪主体为个人和单位；
2、在主观方面必须是出于故意；
3、客观方面表现为生产者违反国家的药品管理法律、法规，生产、销售假药，足以严重危害人体健康的行为；
4、侵犯客体是国家对药品的管理制度。
法律依据：《刑法》第一百四十二条
生产、销售劣药，对人体健康造成严重危害的，处三年以上十年以下有期徒刑，并处罚金；后果特别严重的，处十年以上有期徒刑或者无期徒刑，并处罚金或者没收财产。
药品使用单位的人员明知是劣药而提供给他人使用的，依照前款的规定处罚。
