释义	法律分析：构成虚假广告罪判处二年以下有期徒刑或者拘役，并处或者单处罚金。单位犯本罪的，对单位判处罚金，对其直接负责的主管人员和其他直接责任人员依个人犯罪的规定追究刑事责任。本罪属情节犯，其不仅要求具有违反国家规定，利用虚假广告对商品或服务作虚假宣传的行为，而且还必须达到情节严重的程度才能构成本罪。法律依据：《中华人民共和国刑法》第二百二十二条广告主、广告经营者、广告发布者违反国家规定，利用广告对商品或者服务作虚假宣传，情节严重的，处二年以下有期徒刑或者拘役，并处或者单处罚金。
