释义	法律分析：我国现在的行政法有两大基本原则:合理性和合法性原则，由于我们国家现在还没有统一的行政法典，具体的法律内分布在各个具体的法律规范中，所以在行政行为时既要合法又要合理。法律依据：《中华人民共和国行政处罚法》第四条行政处罚遵循公正、公开的原则。设定和实施行政处罚必须以事实为依据，与违法行为的事实、性质、情节以及社会危害程度相当。对违法行为给予行政处罚的规定必须公布；未经公布的，不得作为行政处罚的依据。
