提起附带民事诉讼的期间有什么规定 |

在侦查、预审、审查起诉阶段，有权提起附带民事诉讼的人向公安机关、人民检察院提出赔偿要求，已经公安机关、人民检察院记录在案的，刑事案件起诉后，人民法院应当按附带民事诉讼案件受理;经公安机关、人民检察院调解，当事人双方达成协议并已给付，被害人又坚持向法院提起附带民事诉讼的，人民法院也可以受理。
提起附带民事诉讼一般应当提交附带民事诉状。书写诉状确有困难的，可以口头起诉。审判人员应当对原告人的口头诉讼请求详细询问，并制作笔录，向原告人宣读;原告人确认无误后，应当签名或者盖章。
人民法院收到附带民事诉状后，应当进行审查，并在七日内决定是否立案。符合刑事诉讼法第七十七条第一、二款以及本解释第八十八条规定的，应当受理;不符合规定的，应当裁定驳回起诉。
人民法院受理附带民事诉讼后，应当在五日内向附带民事诉讼的被告人送达附带民事起诉状副本，或者将口头起诉的内容及时通知附带民事诉讼的被告人，并制作笔录。被告人是未成年人的，应当将附带民事起诉状副本送达其法定代理人，或者将口头起诉的内容通知其法定代理人。
人民法院送达附带民事起诉状副本时，应当根据刑事案件审理的期限，确定被告人或者其法定代理人提交民事答辩状的时间。
