释义	信用卡欠款3万还不上不一定会坐牢。信用卡逾期会坐牢的标准： 1、信用卡逾期达到一万元及以上的，只有符合恶意透支的，才会构成信用卡诈骗罪，会处以刑罚； 2、以非法占有为目的或者超过规定限额或者规定期限透支，经发卡银行两次有效催收后超过三个月仍不归还的。发卡银行违规以信用卡透支形式变相发放贷款，不算恶意透支； 3、判断行为人是否非法占有为目的恶意透支，应当综合持卡人信用记录、还款能力和意愿、申领和透支信用卡的状况、透支资金的用途、透支后的表现、未按规定还款的原因等情节。
