释义	一方无音讯的，另一方可以到其住所地的人民法院提起离婚诉讼。若是下落不明满二年的，可以选择先向法院申请其为失踪人，待人民法院作出宣告失踪判决后，再向法院提起离婚诉讼。法律依据：《民法典》第一千零七十九条夫妻一方要求离婚的，可以由有关组织进行调解或者直接向人民法院提起离婚诉讼。人民法院审理离婚案件，应当进行调解；如果感情确已破裂，调解无效的，应当准予离婚。第四十条自然人下落不明满二年的，利害关系人可以向人民法院申请宣告该自然人为失踪人。
