释义	法律分析：占有物返还请求权发生于占有物被侵夺的情形。此种侵夺占有而构成的侵占，是指非基于占有人的意思，采取违法的行为使其丧失对物的控制与支配。需要注意的是．非因他人的侵夺而丧失占有的，如因受欺诈或者胁迫而交付的，不享有占有物返还请求权。法律依据：《中华人民共和国民法典》第二百五十八条国家所有的财产受法律保护，禁止任何组织或者个人侵占、哄抢、私分、截留、破坏。第二百六十五条集体所有的财产受法律保护，禁止任何组织或者个人侵占、哄抢、私分、破坏。
