释义	律师分析：行为人已经预见会发生危害结果，由于当时主客观条件的限制，行为人无力防止危害结果的发生，以致发生危害结果。不是犯罪。【法律依据】：《中华人民共和国刑法》第十六条行为在客观上虽然造成了损害结果，但是不是出于故意或者过失，而是由于不能抗拒或者不能预见的原因所引起的，不是犯罪。
