释义	法律分析：提交投标文件的投标人少于三个的，招标人应当依法重新招标。重新招标后投标人仍少于三个的，属于必须审批的工程建设项目，报经原审批部门批准后可以不再进行招标;其他工程建设项目，招标人可自行决定不再进行招标。法律依据：《工程建设项目施工招标投标办法》第三十八条投标人应当在招标文件要求提交投标文件的截止时间前，将投标文件密封送达投标地点。招标人收到投标文件后，应当向投标人出具标明签收人和签收时间的凭证，在开标前任何单位和个人不得开启投标文件。
