释义	法律分析：如果被宣告失踪或死亡的配偶又回来了，可能会申请撤销其失踪或死亡的宣告，财产关系应当恢复原状，但人身关系不自动恢复。但是一旦已经进行离婚诉讼并得到离婚判决，或者经宣告其死亡后婚姻关系已经解除了，婚姻关系不可自动恢复。法律依据：《中华人民共和国民法典》第五十一条被宣告死亡的人的婚姻关系，自死亡宣告之日起消除。死亡宣告被撤销的，婚姻关系自撤销死亡宣告之日起自行恢复。但是，其配偶再婚或者向婚姻登记机关书面声明不愿意恢复的除外。
