法律分析：在我国公司法人代表好变更，变更法人代表前，先要召开股东大会，并取得所有股东的同意。全体股东在相关法定文件上签字。工商局只有收到有全体股东签字的材料才能受理变更事宜。
法律依据：《中华人民共和国公司法》第十三条 公司法定代表人依照公司章程的规定，由董事长、执行董事或者经理担任，并依法登记。公司法定代表人变更，应当办理变更登记。
