释义	医疗事故不是医疗事故罪。医疗事故罪是指医务人员由于严重不负责任，造成就诊人死亡或者严重损害就诊人身体健康的行为。发生医疗事故满足医疗事故罪的全部要件的，会构成此罪。【法律依据】《刑法》第三百三十五条医务人员由于严重不负责任，造成就诊人死亡或者严重损害就诊人身体健康的，处三年以下有期徒刑或者拘役。第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
