一起去钓鱼出意外，一般属于不可抗力，不承担责任。若损害是因第三人造成的，第三人应当承担侵权责任。
法律依据：
《中华人民共和国民法典》
第一百八十条 因不可抗力不能履行民事义务的，不承担民事责任。法律另有规定的，依照其规定。
不可抗力是不能预见、不能避免且不能克服的客观情况。
第一千一百六十五条 行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。
依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
