问题	一般重婚行为与重婚罪的界线
释义	我国现行刑法没有规定重婚行为与重婚罪的界线。但我认为重婚是严重触犯我国刑律，社会危害性比较严重的行为。根据我国刑法第258条的规定，首先，重婚罪是指有配偶者在婚姻登记机关再次与他人登记结婚的行为;其次，根据最高人民法院1994年12月司法解释：“有配偶的人与他人以夫妻名义同居生活的，或者明知他人有配偶而与之以夫妻名义同居生活的，仍应按重婚罪定罪处罚”的规定，包括了有配偶的人虽未经与他人结婚登记，但却与他人以夫妻名义同居生活的行为。可见，重婚包括法律上的重婚和事实上的重婚罪。
