释义	法律分析：契据登记制度的理论基础是对抗要件主义，这一理论认为房地产产权的变更、他项权利的设定，在当事人订立合约之时就已生效，即双方一经产生债的关系，房地产权利的转移或他项权利的设定即同时成立。登记仅仅是作为对抗第三人的要件，所以称为对抗要件主义。法律依据：《中华人民共和国民法典》第二百二十五条船舶、航空器和机动车等的物权的设立、变更、转让和消灭，未经登记，不得对抗善意第三人。
