释义	法律分析：不能转租情况一，承租人拖欠租金的、承租人在承租房屋内擅自搭建的、预租的商品房三种房屋不得转租。不能转租情况二，约定可以转租的，承租人可以按照约定转租房屋。法律依据：《最高人民法院关于审理城镇房屋租赁合同纠纷案件具体应用法律若干问题的解释》第十五条承租人经出租人同意将租赁房屋转租给第三人时，转租期限超过承租人剩余租赁期限的，人民法院应当认定超过部分的约定无效。但出租人与承租人另有约定的除外。
