释义	法律分析: 破产财产处置前，应当由具有法定资格的资产评估机构进行评估，并以评估价值作底价，通过拍卖、招标等方式依法转让。企业破产时，企业依法取得的土地使用权，应当以拍卖或者招标方式为主依法转让，转让所得首先用于破产企业职工的安置；安置破产企业职工后有剩余的，剩余部分与其他破产财产统一列入破产财产分配方案。法律依据: 《中华人民共和国企业破产法》第四条国家通过各种途径妥善安排破产企业职工重新就业，并保障他们重新就业前的基本生活需要，具体办法由国务院另行规定。
