释义	未满16岁之前,不算工龄。单位禁止招收不满16岁的未成年人,不满16岁的未成年人,不具有法定劳动者资格,与录用单位不是劳动关系,做童工的工作年限不能计算工龄。但经过国家批准的文艺、体育单位,经有关机关批准招收的人员除外。法律依据：《中华人民共和国民法典》第十八条成年人为完全民事行为能力人，可以独立实施民事法律行为。十六周岁以上的未成年人，以自己的劳动收入为主要生活来源的，视为完全民事行为能力人。
