释义	法律分析：根本违约，是指合同一方当事人违反合同，致使该合同的目的不能实现的行为;一般违约仅指合同一方当事人违反合同，但并不导致该合同目的不能实现的行为。当事人一方出现根本违约时，合同相对方获得合同解除权，而当一方仅仅出现一般违约时，合同相对方并不获得合同解除权只可以要求违约方承担一般违约的违约责任。法律依据：《中华人民共和国民法典》第一百八十六条因当事人一方的违约行为，损害对方人身权益、财产权益的，受损害方有权选择请求其承担违约责任或者侵权责任。
