法律依据：
《中华人民共和国劳动合同法》 第三十二条 劳动者拒绝用人单位管理人员违章指挥、强令冒险作业的，不视为违反劳动合同。
《中华人民共和国劳动法》 第四十二条 第一款发生自然灾害、事故或者因其他原因，威胁劳动者生命健康和财产安全，需要紧急处理的，不受《劳动法》第四十一条，即延长加班的限制。
