配偶权属于人格权吗 |

法律分析：关于配偶权是人格权还是身份权的这个问题法律并无明确规定，配偶权具有以下特征：
(1)主体的对偶性。夫妻互为配偶，共同享有配偶权，双方既是权利主体，又是义务主体，这是婚姻关系的自然属性所决定的。
(2)客体的利益性。配偶权的客体是夫妻互为配偶的身份利益，不包括财产利益，且这种利益具有独占性，其他任何人都不得共享，这是我国一夫一妻的婚姻制度所决定的。
(3)内容的双重性，即权利义务的不可分割性。配偶权的核心是性权利。一是这种权利义务的实现需要双方同时履行和协调配合是配偶双方既是权利主体，又是义务主体，缺一不可。
(4)权利的排他性，权利的独占性必须就具有排他性，从某种意义上说配偶权也是对世权，即夫妻以外的人都是义务主体，都具有不作为的义务，不得实施干扰、妨害、侵犯配偶权的行为。

第九百九十条 人格权是民事主体享有的生命权、身体权、健康权、姓名权、名称权、肖像权、名誉权、荣誉权、隐私权等权利。
除前款规定的人格权外，自然人享有基于人身自由、人格尊严产生的其他人格权益。
第九百九十一条 民事主体的人格权受法律保护，任何组织或者个人不得侵害。
第一千零五十七条 夫妻双方都有参加生产、工作、学习和社会活动的自由，一方不得对另一方加以限制或者干涉。
