释义	法律分析：不能，农村宅基地归集体所有、宅基地上面没有房子不能房屋确权，办理建房审批手续后两年内没有建房子的审批手续作废宅基地收回。法律依据：《确定土地所有权和使用权的若干规定》第五十二条空闲或房屋倒塌、拆除两年以上未恢复使用的宅基地，不能确定使用权，对于已经确权的宅基地，经过县级人民政府批准之后，将会注销土地登记，宅基地由农村集体组织收回。
