释义	法律分析：犯罪嫌疑人不承认盗窃并不意味着就不会被批捕。只要符合三个条件： 1、有证据证明有犯罪事实； 2、可能判处徒刑以上刑罚； 3、采取取保候审、监视居住等方法，尚不足以防止发生社会危险性，而有逮捕必要的。即使犯罪嫌疑人、被告人符合上述两项条件，但采取取保候审或者监视居住足以防止其危害社会的，就无逮捕必要。法律依据：《中华人民共和国刑事诉讼法》第九十条人民检察院对于公安机关提请批准逮捕的案件进行审查后，应当根据情况分别作出批准逮捕或者不批准逮捕的决定。
