释义	叛逃罪的构成要件： 1、犯罪主体为特殊主体，即国家机关工作人员； 2、主观方面只能表现为故意； 3、犯罪客体是国家安全； 4、客观方面表现为行为人在履行公务期间，撤离岗位，叛逃或者在境外叛逃的行为。【法律依据】《刑法》第一百零九条国家机关工作人员在履行公务期间，擅离岗位，叛逃境外或者在境外叛逃的，处五年以下有期徒刑、拘役、管制或者剥夺政治权利；情节严重的，处五年以上十年以下有期徒刑。掌握国家秘密的国家工作人员叛逃境外或者在境外叛逃的，依照前款的规定从重处罚。
