行政拘留所可以抽烟吗 -法律知识

法律分析：
拘留所没有明文规定不能抽烟。在一般情况下是不能抽的。看守所是否禁止吸烟,法律法规没有明确规定。但同监舍往往关押多个犯罪嫌疑人,活动空间狭小,允许吸烟势必导致其他人被动吸烟,危害他人健康,侵害他人健康权,因此监舍是不允许吸烟的。犯罪嫌疑人关进看守所,烟都会被暂扣离开时返还。
法律依据：
《中华人民共和国刑事诉讼法》 第八十六条 公安机关对被拘留的人，应当在拘留后的二十四小时以内进行讯问。在发现不应当拘留的时候必须立即释放，发给释放证明。
