释义	审判的时候怀孕的妇女，不适用死刑。在执行死刑的过程中，发现罪犯正在怀孕的，应当停止执行，并且立即报告最高人民法院，由最高人民法院作出裁定;裁定停止执行的，应当报请最高人民法院依法改判。法律依据:《中华人民共和国刑法》第四十九条审判的时候怀孕的妇女，不适用死刑。《中华人民共和国刑事诉讼法》第二百五十一条在执行死刑的过程中，发现罪犯正在怀孕的，应当停止执行，并且立即报告最高人民法院，由最高人民法院作出裁定;裁定停止执行的，应当报请最高人民法院依法改判。
