商标侵权一般怎么处罚？ |

法律分析：
1、立即责令侵权者停止销售使用相同或相似商标的商品。2、销毁和收缴侵权者的商标标识。3、消除侵权者现在的商品上的侵权商标，禁止其再次使用。4、印制侵权商标时使用的印板、模具以及相应工具井收缴。5、以上措施仍然不能制止其侵权行为，或者与商品相关的侵权行为没有停止的，工商管理部将责令并且监督侵权者对侵权商品进行销毁。6、除上述之外，还要依情节轻重处以经济罚款，数额是百分之五以下的非法经营额， 或是低于五倍利润的罚款。对相关侵权单位的直接负责人处以1万元以下的罚款。并且还要对被侵权人的所有损失进行赔偿。

《中华人民共和国民法典》
第一百二十条 民事权益受到侵害的，被侵权人有权请求侵权人承担侵权责任。
第一百八十三条 因保护他人民事权益使自己受到损害的，由侵权人承担民事责任，受益人可以给予适当补偿。没有侵权人、侵权人逃逸或者无力承担民事责任，受害人请求补偿的，受益人应当给予适当补偿。
第一千一百六十七条 侵权行为危及他人人身、财产安全的，被侵权人有权请求侵权人承担停止侵害、排除妨碍、消除危险等侵权责任。
第一千一百六十八条 二人以上共同实施侵权行为，造成他人损害的，应当承担连带责任。
