释义	法律分析：民事案件法院已经宣判，判决了的案件,原告不可以撤诉。在人民法院受理案件之后，宣告判决之前，原告可以要求撤回其起诉的行为。按实际情况，由于案件已经判决，原告无法申请撤诉，如果原告对判决不服的，可以在上诉期内上诉，也可以依法申请再审。法律依据：《民事诉讼法》第一百二十四条人民法院对下列起诉，分别情形，予以处理：（五）对判决、裁定、调解书已经发生法律效力的案件，当事人又起诉的，告知原告申请再审，但人民法院准许撤诉的裁定除外；
