释义	法律分析: 集资房是改变住宅建设由国家和单位包的传统制度，实行政府、单位、职工个人三方面共同承担建房成本，通过多方筹集资金进行房屋建设而不通过市场购买而直接分配的一种房屋。小产权房是指在农民集体土地上建设的房屋，未缴纳土地出让金等费用，其产权证不是由国家房管部门颁发，而是由乡政府或村委会颁发，所以叫做乡产权房，又叫小产权房。法律依据: 《中华人民共和国土地管理法》第六十三条小产权房不能向非本集体成员的第三人转让或出售，即购买后不能合法转让过户。
