公司法定代表人连带责任吗 |

公司民事责任由公司财产承担，所以法人代表一般对公司承担连带责任。但法人代表有职务侵权行为的，公司承担责任后，可以向法人代表追偿。
《中华人民共和国民法典》
第六十条【法人民事责任承担】法人以其全部财产独立承担民事责任。
第六十一条【法定代表人的定义及行为的法律后果】依照法律或者法人章程的规定，代表法人从事民事活动的负责人，为法人的法定代表人。
法定代表人以法人名义从事的民事活动，其法律后果由法人承受。
法人章程或者法人权力机构对法定代表人代表权的限制，不得对抗善意相对人。
第六十二条【法定代表人职务侵权行为的责任承担】法定代表人因执行职务造成他人损害的，由法人承担民事责任。
法人承担民事责任后，依照法律或者法人章程的规定，可以向有过错的法定代表人追偿。
一、公司法定代表人的责任
1、民事责任
(1)损失赔偿责任。因法定代表人的故意、过失或者违反法律行政法规或公司章程的规定而给公司造成损失，公司有权就该损失向法定代表人主张赔偿责任。
(2)法定代表人滥用职权所获取的收入归入公司。
2、法定代表人可能承担的行政责任
如果公司存在非法经营、抽逃资金、隐匿财产逃避债务的行为，作为企业的法定代表人，法院可以直接对其进行罚款，同时可以向有关部门提出司法建议，由有关部门给予行政处分。当然，法定代表人不知情且无过错的除外。
3、法定代表人可能承担的刑事责任如下：
一般情况下，对于公司的犯罪行为，应由公司承担刑事责任，法定代表人并不因此而承担刑事责任。但是考虑到多数情况下公司犯罪是按照公司主管人员的意志而实施的，因此，公司犯罪时不仅仅会处罚公司，很多情况下还会追究主管人员和主要负责人的责任，称之为双罚制度。在双罚制度下，直接负责的主管人员通常会被理解成企业的法定代表人。
