可以。可向法院递交起诉状，法院将起诉状送达给服刑一方，并让他签字同意。如服刑一方不同意签字，法院同样可以安排开庭的时间，在服刑一方服刑场所开庭审理。最后法院会根据夫妻感情是否破裂，做出判决。虽然一方属于正在服刑的犯人，人身自由受到剥夺，但是我国法律对离婚的判决也是有法律依据的，公平合理的。

根据《民法典》第1079条规定：夫妻一方要求离婚的，可以由有关组织进行调解或者直接向人民法院提起离婚诉讼。
