释义	根据《刑法》、《治安管理处罚条例》等法律规定，在我国，卖淫嫖娼不构成犯罪，是违法行为，依据《治安管理处罚法》第六十六条规定，卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款；情节较轻的，处五日以下拘留或者五百元以下罚款。对明知自己患有梅毒、淋病待严重性病卖淫、嫖娼的，处5年以下有期徒刑、拘投或者管制。
