释义	法律分析：建房证是集体土地上建房的一种凭证，相当于国有土地上建房颁发的建设工程规划许可证。在集体土地转为国有土地，办理房产证时，建房证是证明建房合法的唯一凭证，没有建房证是不能办理房产证的。法律依据：《中华人民共和国行政许可法》第五十七条有数量限制的行政许可，两个或者两个以上申请人的申请均符合法定条件、标准的，行政机关应当根据受理行政许可申请的先后顺序作出准予行政许可的决定。但是，法律、行政法规另有规定的，依照其规定。
